- Malone was a judge for the Suffolk County District Court, 5th District, in Islip Town from 2018 to 2020.
- Malone served on the Southampton Town Council from 2010 to 2014.
- He received his undergraduate degree in 1983 from Clarkson University in upstate Potsdam and a law degree from Touro College, Jacob D. Fuchsberg Law Center, in 2005. He was admitted to the bar in 2007.
